GENERAL CONDITIONS

M’Place Apartments, based in Palermo (PA), in Via Giorgio Gemellaro, 39, hereinafter referred to as the “sub-lessor”

WHEREAS

– which intends to regulate the terms of the agreement, the content and execution of the contract through the following clauses – general conditions of the sublease contract for tourism purposes;
– that the sub-tenant / final customer declares to have read the following contract conditions. In fact, the system does not allow reservations without first clicking on the relative link and which, read carefully, considers them fair and accepts them in full, given that

PROVIDES THE FOLLOWING

1. The premises are an integral part of the general contract conditions and constitute regulatory and mandatory content for the parties.
2. SUBLOCATION FOR TOURIST PURPOSES. The property is subleased for exclusive tourist purposes for the duration and at the fee (price of the stay) established in the online booking, which is an integral part of these general conditions also for the exact identification of the property, better described therein.
3. PROHIBITION OF SUBLOCATION. It is strictly forbidden for the sub-tenant to sublease the property covered by the contract or to grant it to third parties on loan, use or other title.
4. NON-EXTENDABLE SUBLOCATION. Given its nature for transitory tourist purposes, this contract will terminate upon expiry, meaning from now on it will be canceled on the date of the end of the stay.
5. CONDITION OF EFFECTIVENESS. This sublease agreement will be effective for all legal purposes only after the sub-tenant / customer has made the payment of the entire amount relating to the deposit no later than 72 hours from the confirmation of availability by M’Place. Apartments. Once these terms have elapsed, the reservation is considered canceled without the obligation on the part of M’Place Apartments to notify the sub-tenant in any way. The sub-tenant is obliged to send the bank transfer receipt by email to [email protected] indicating the name and surname used for the reservation and the reservation number in the reservation summary.
6. BALANCE OF THE FEE. The balance of the full amount of the sublease (the cost of the stay including the tourist tax where present) must be made at the exact moment of confirmation of the booking by M’Place Apartments through payment by bank transfer. Failure to pay constitutes a terminating condition of the agreement reached with the online booking and of this contract, with the right of the landlord M’Place Apartments not to hand over the keys and, therefore, the property, to the tenant, and to request the entire price of the stay, making the advance payment an essential element of the contract. Consequently, it is in the right of M’Place Apartments to grant third parties the “unpaid” apartment.
7. NON-REFUNDABLE PAYMENT. If, for any reason, during the sublease relationship, the sub-tenant releases the property in advance of the deadline, he will not be entitled to any refund for the unused period.
In the event that there is an increase in cases of contagion from Covid – 19 or from another epidemic recognized by an express primary or secondary standardization provision by the competent State or Regional authority that prohibits travel or establishes a lockdown, the sub-tenant can request:
– the issuance of a Voucher, valid for a new booking for the summer season 2023 or 2024, based on the availability and conditions on the website www.mplaceapartments.com
– the ability to change 1 date within 30 days before arrival, even for personal reasons, based on the availability and conditions on the website www.mplaceapartments.com
8. TAKE OVER AND DELAY. It is mandatory to notify M’Place Apartments customer service in the event that the apartment is not taken over on the day established in the booking. M’Place Apartments is obliged to keep the leased property confidential for 24 hours after the date and time of arrival indicated in the contract. If no time is specified, the 24 hours will expire at 9:00 the next day. In the event of failure to take delivery of the keys within and no later than 24 hours later, the amount paid by the sub-tenant is understood to be fully lost. In the event of unavailability of the apartment or breach of contract by the company M’Place Apartments, the amount will be refunded or an equivalent apartment will be offered to the sub-tenant at the same economic conditions defined in the booking summary.
9. NUMBER OF GUESTS AND ANIMALS. It is forbidden to stay with a greater number of guests than those foreseen by the rented apartment. M’Place Apartments, through its collaborators, reserves the right to check the actual number of guests who will occupy the apartment being subleased. In the event of a finding of a higher number than that indicated by the sub-tenant in the booking, there is a supplement of € 100.00 (one hundred euros / 00) for each additional person, which the sub-tenant will be required to pay to the lessor. Small dogs (max 10 kgs) are accepted. All guests are also required to observe the condominium rules generally in force, in particular the rules relating to quiet during the afternoon (from 14.00 to 16.00) and at night (from 00.00 to 08.00).
10.  DAMAGES. The apartment must be left in a state of perfect order and cleanliness, free of garbage or any waste, with the dishes washed and the fridge defrosted. The sub-tenant undertakes to return the apartment in the same condition in which it was delivered at the time of check-in and to promptly report any damage, problems, malfunctions, shortages of tools or other to the sub-lessor. M’Place Apartments will repair it as soon as possible, always compatibly with the availability of material and technical staff. The sub-lessor reserves the right to contact the sub-tenant, even after his departure, to exercise the rights under this clause.
11. PRICES AND EQUIPMENT OF THE APARTMENTS. The prices in the price list are per apartment and are intended for a one week stay. All apartments are fully furnished, equipped with hot and cold water and electricity, equipped with basic dishes, kitchen or kitchenette, refrigerator. The lift, washing machine, flat-screen TV, iron, air conditioning and other options are present, only if specified in the data sheet of the apartment.
12. DISCLAIMER. The sub-tenant exonerates M’Place Apartments from any responsibility for events that may occur during the stay not attributable to the fact and will of the same, as well as exempts it from liability for events caused by force majeure that might force it to cancel the reservation, in his faculty. M’Place Apartments is also not liable for any theft and damage suffered by the sub-tenant during the stay as there is no reliance on custody of assets of any kind.
13. DISCIPLINE IN THE EVENT OF COVID – 19. The sub-tenant will not be able to withdraw from the booking if there is an increase in cases of contagion from Covid – 19 or from another epidemic in Italy or in the world. The right of withdrawal of the sub-tenant will exist only where it is recognized by an express provision of primary or secondary standardization by the competent State or Regional authority that prohibits travel or establishes a lockdown. Otherwise, in the event of a worrying increase in contagion from Covid – 19 or another epidemic, but in the absence of government measures, the sub-lessor has the right to decide to cancel the booking in order to protect the health of customers and people in general. In this case, it is in his power to deliver a voucher of the same amount, unless the obligation of one or the other solution is imposed by a state law that has intervened in the meantime.
14. ARRIVAL AND DEPARTURE TIMES. Upon delivery of the keys and balance of the sublease, the sub-tenant must show his own identity document and that of the other guests. The apartments will be made available from 4.00 pm to 6.00 pm on the day of arrival (the M’Place Apartments reception service must be contacted to collect the keys) and must be vacated no later than 11.00 am on the day of departure. in perfect order and cleanliness, without garbage or waste, with the dishes washed, the refrigerator empty and the furniture in place. The keys will be returned where indicated by the staff. In case of arrival earlier than 4.00 pm, early check-in may be allowed, subject to telephone or electronic communication, but not entry into the apartment, which will always take place starting at 4.00 pm. Should the arrival be delayed, it is mandatory to notify the M’Place Apartments reception staff at the reference numbers indicated in the information email received prior to arrival.
15. JURISDICTION. For any dispute that may arise regarding the execution and interpretation of this contract, the exclusive jurisdiction of the Court of Palermo is agreed between the parties.
